Terms and Conditions
These Terms and Conditions govern your access to and use of Boomn, including our social commerce platform, creator studio, messaging, livestream, events, wallet, subscription, payment, AI, website, and progressive web app features.
Using Boomn
- You must be at least 13 years old to use Boomn. If you use Boomn on behalf of a business, you confirm that you have authority to bind that business.
- You are responsible for your account, credentials, profile, posts, messages, events, livestreams, payments, integrations, and all activity that occurs through your account.
- You agree to provide accurate information, keep it current, and promptly secure your account if you suspect unauthorized access.
- Boomn may change, suspend, or discontinue features at any time, including beta, AI, monetization, platform-sharing, livestream, wallet, and studio features.
User content
- You keep ownership of content you create or upload, but you grant Boomn a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, modify for formatting, promote, and otherwise use that content to operate and improve Boomn.
- You represent that you have all rights needed to post, upload, livestream, share, sell, promote, or import your content and that your content does not violate law or third-party rights.
- Public content such as profiles, posts, events, livestreams, offers, and creator pages may be seen, shared, saved, indexed, or discussed by others.
- We may remove, limit, label, demote, or report content that appears to violate these terms, platform rules, payment rules, law, or safety standards.
Rules of conduct
- Do not use Boomn for harassment, hate, threats, exploitation, illegal activity, fraud, spam, impersonation, deceptive business practices, intellectual property infringement, or attempts to bypass moderation or security systems.
- Do not upload malware, scrape the service, reverse engineer private systems, abuse APIs, interfere with performance, or attempt unauthorized access to accounts, data, payments, or infrastructure.
- Do not use livestream, video, messaging, wallet, event, or AI features to harm others, mislead users, collect sensitive data without consent, or violate applicable rules.
- Reports, moderation signals, account restrictions, and enforcement decisions may be used to protect users, payment partners, and the platform.
Payments, subscriptions, and wallet features
- Paid products, subscriptions, creator tools, transfers, withdrawals, tips, bookings, and checkout features may be processed by Stripe or other payment providers and are subject to their terms.
- Prices, tiers, taxes, fees, availability, trial terms, renewal terms, and feature limits may change as permitted by law. Subscription access may renew until canceled.
- Wallet balances, transfers, withdrawals, and payment links may require identity, fraud, eligibility, or compliance checks. Transactions may be delayed, declined, reversed, or limited.
- You are responsible for your tax obligations, payout details, refund commitments, customer obligations, and compliance with laws that apply to your business or creator activity.
AI and recommendations
- Boomn offers AI-assisted captions, ideas, imports, recommendations, and assistant experiences. AI output may be inaccurate, incomplete, similar to other output, or unsuitable for your use.
- You are responsible for reviewing, editing, fact-checking, and legally clearing AI-assisted content before publishing, selling, or relying on it.
- Do not submit confidential, regulated, private, or third-party information to AI features unless you have permission and accept the associated risks.
Third-party services
- Boomn may integrate with services such as Firebase, Stripe, Resend, Agora, Google services, AI providers, analytics tools, social platforms, and linked creator accounts.
- Third-party services are governed by their own terms and privacy policies. Boomn is not responsible for third-party services, outages, permissions, data practices, platform decisions, or payment-provider actions.
- If you connect external platforms, you authorize Boomn to access and use permitted account, page, channel, analytics, publishing, or profile data to provide connected features.
Disclaimers and liability
- Boomn is provided "as is" and "as available" without warranties of any kind to the fullest extent permitted by law.
- We do not guarantee uninterrupted availability, specific revenue, creator growth, bookings, payment outcomes, recommendation accuracy, AI quality, content preservation, or third-party platform access.
- To the fullest extent permitted by law, Boomn will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities.
- You agree to indemnify Boomn from claims, losses, liabilities, costs, and expenses arising from your content, account activity, business activity, violation of these terms, or misuse of the service.
Changes and termination
- We may update these terms from time to time. Continued use of Boomn after updates means you accept the updated terms.
- You may stop using Boomn at any time. We may suspend or terminate access if we believe you violated these terms, created risk, caused harm, or triggered legal, payment, security, or platform concerns.
- Sections that by nature should survive termination will survive, including content licenses, payment obligations, disclaimers, liability limits, indemnity, and dispute provisions.
